Card Cubbie Terms of Service

1. Welcome to Card Cubbie
These Terms of Service (the “Terms”) govern your access to and use of the Card Cubbie mobile application, websites, software, features, content, subscriptions, reminders, wallet features, shared Cubbie Wallet features, and related services (collectively, the “Service”).
The Service is operated by Arch Harbour LLC d/b/a Card Cubbie, a Florida limited liability company (“Card Cubbie,” “we,” “us,” or “our”).
By creating an account, accessing the Service, using the Service, or purchasing Card Cubbie Plus, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Important gift card disclaimer
Card Cubbie is a digital organization tool for gift cards. Unless we expressly state otherwise in writing:
- Card Cubbie does not issue, sell, load, reload, activate, redeem, transfer, broker, or exchange gift cards.
- Card Cubbie does not hold gift card funds for you.
- Card Cubbie is not a bank, money transmitter, stored-value issuer, gift card issuer, credit provider, broker, or financial institution.
- Card Cubbie is not affiliated with, sponsored by, endorsed by, or approved by any retailer, restaurant, merchant, payment network, or gift card issuer unless we expressly say so.
- Gift cards remain subject to the terms, policies, balances, expiration rules, fees, limitations, and redemption rules of the applicable merchant or issuer.
- Some merchants may require a physical card, original email, printed certificate, or other proof of ownership at redemption. Storing a card in Card Cubbie does not guarantee that a merchant will accept it.
- Card balances, expiration dates, redemption status, and reminders may be incomplete, inaccurate, delayed, or unavailable.
You are responsible for keeping any physical card, email, receipt, activation proof, PIN, or other documentation required by the merchant or issuer.
3. Eligibility
You must be at least 13 years old, or the minimum age required in your country to use online services, to use Card Cubbie. If you are under the age of majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian.
The Service is not directed to children under 13. You may not use the Service if you are prohibited from doing so under applicable law.
4. Your account
You may need to create an account to use some or all of the Service. You agree to provide accurate information and keep your information current.
You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity under your account;
- protecting devices on which you use Card Cubbie;
- promptly notifying us of any unauthorized access or suspected security issue.
We may suspend or terminate your account if we believe your account is being used unlawfully, fraudulently, abusively, or in violation of these Terms.
5. User gift card information and wallet content
You may choose to store information about physical and digital gift cards, including retailer names, categories, balances, card images, card numbers, PINs, barcodes, notes, reminders, wallet names, and shared wallet permissions (“Wallet Content”).
You represent and warrant that:
- you have the right to store and use the Wallet Content you add to the Service;
- you will not add stolen, fraudulent, counterfeit, unauthorized, or unlawfully obtained cards;
- you will not use Card Cubbie to facilitate fraud, theft, money laundering, unauthorized resale, unauthorized transfer, or any illegal activity;
- you will not use the Service to test, validate, guess, scrape, or exploit card numbers, PINs, barcodes, balances, or merchant systems.
You retain ownership of your Wallet Content. You grant Card Cubbie a limited, worldwide, non-exclusive license to host, store, process, display, transmit, back up, and use your Wallet Content solely to operate, secure, maintain, improve, and provide the Service, including reminders, wallet sharing, account recovery, customer support, and features you request.
6. Shared Cubbie Wallets
Card Cubbie may allow you to create or participate in shared Cubbie Wallets.
When you invite another person to a shared Cubbie Wallet, you authorize that person to access the wallet information and perform any actions permitted by the role or permissions you assign. Depending on your settings, shared Cubbie Wallet members may be able to view, add, edit, move, delete, or use cards in the wallet.
You are responsible for:
- choosing whom to invite;
- setting appropriate permissions;
- monitoring shared Cubbie Wallet activity;
- removing members when access is no longer appropriate;
- resolving disputes among shared Cubbie Wallet members.
Card Cubbie is not responsible if a person you invited views, copies, spends, redeems, deletes, or misuses a gift card or Wallet Content that you shared with them.
7. Card Cubbie Plus
Card Cubbie may offer a paid subscription called Card Cubbie Plus.
Card Cubbie Plus may include:
- more than five individually owned active cards;
- more than one shared Cubbie wallet;
- other features we may add, change, or remove from time to time.
Card Cubbie Plus is optional. Free users may continue to use available free features, subject to limits we set.
7.1 Subscription billing
If you purchase Card Cubbie Plus through Apple App Store, Google Play, or another authorized app store, your purchase, renewal, cancellation, refunds, taxes, and payment method are handled by that store and are also subject to that store’s terms.
Unless canceled before the renewal date, subscriptions automatically renew for the selected billing period. You can manage or cancel your subscription through your App Store or Google Play account settings, or through any subscription management link we provide when available.
We do not receive your full payment card number from Apple or Google.
7.2 Free trials, promotions, and price changes
We may offer free trials, promotional pricing, discounts, or introductory offers. Eligibility may vary by user, platform, country, or store account.
If we change subscription prices, the applicable store may require notice or consent before the change takes effect. If you do not agree to a price change, you may cancel your subscription before the new price applies.
7.3 Refunds
Refunds for purchases made through Apple App Store or Google Play are generally handled by the applicable store according to its policies. We may provide assistance where possible but cannot guarantee refunds controlled by a third-party store.
8. Card limits and feature availability
Free plans may be subject to limits on individually owned active cards and shared Cubbie Wallets. Card Cubbie Plus may provide higher limits as described in the app.
We may add, change, suspend, or remove features and limits over time. Where required by law or applicable store rules, we will provide notice of material changes that negatively affect a paid subscription.
9. Reminders
Card Cubbie may provide reminders about card balances, expiration dates, or nearby locations. Reminders are provided for convenience only and may be inaccurate, incomplete, delayed, or unavailable.
You are responsible for confirming card balances, expiration dates, and redemption requirements with the applicable merchant or issuer before relying on a reminder.
10. Location-based features
Card Cubbie may offer optional location-based reminders. If you enable these features, your device or account settings may allow you to disable location access at any time.
Location-based features may be inaccurate or unavailable. You should not rely on Card Cubbie for emergency, safety-critical, navigation-critical, or time-critical purposes.
11. Privacy
Our Privacy Policy explains how we collect, use, share, retain, and protect information. By using the Service, you acknowledge our Privacy Policy.
You can access privacy controls in the app. Third-party marketing/tracking controls are off by default unless and until you choose otherwise through a future compliant opt-in flow.
12. Acceptable use
You agree not to:
- use the Service for unlawful, fraudulent, deceptive, abusive, or harmful purposes;
- upload stolen, fake, fraudulent, or unauthorized gift cards;
- access or use another person’s account or wallet without permission;
- copy, scrape, harvest, validate, guess, or test gift card numbers, PINs, balances, or barcodes;
- reverse engineer, decompile, tamper with, or bypass the Service;
- interfere with security, rate limits, access controls, payment systems, subscriptions, or entitlement checks;
- upload malware, harmful code, or content that violates another person’s rights;
- use the Service to infringe intellectual property, privacy, publicity, or other rights;
- use the Service in a way that could damage Card Cubbie, users, merchants, app stores, payment processors, or other third parties.
We may investigate and take action, including suspending or terminating accounts, removing content, limiting access, or notifying law enforcement if we believe these Terms have been violated.
13. Intellectual property
The Service, including the Card Cubbie name, logos, software, interfaces, designs, text, graphics, features, and other content, is owned by Card Cubbie or its licensors and is protected by intellectual property and other laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Service for your personal, non-commercial use.
You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Service except as permitted by law or with our written permission.
If you send us feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation to you.
14. Third-party services
The Service may link to, integrate with, or rely on third-party services, including app stores, cloud hosting providers, analytics providers, crash reporting providers, customer support providers, AI service providers, merchants, and payment-related services.
Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, content, availability, security, or practices.
15. App store terms
If you downloaded Card Cubbie from the Apple App Store, Google Play, or another app store, the applicable store terms also apply. The app store provider is not responsible for providing maintenance or support for Card Cubbie unless required by applicable law.
For Apple users, Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent required by Apple’s applicable terms, and Apple may enforce these Terms against you as a third-party beneficiary.
16. Changes to the Service
We may modify, suspend, discontinue, limit, or replace any part of the Service at any time. We may also change free limits, Plus features, supported platforms, reminders, or wallet functionality.
If we make material changes that negatively affect a paid subscription, we will provide notice where required by law or applicable store rules.
17. Termination
You may stop using the Service at any time. You may delete your account through the app if available or by contacting us.
We may suspend or terminate your account or access to the Service if:
- you violate these Terms;
- we believe your use creates risk or legal exposure;
- required by law, app store policy, or third-party provider restriction;
- your account appears fraudulent, inactive, compromised, or abusive;
- we discontinue the Service.
Termination does not automatically cancel a subscription purchased through an app store. You must cancel through the applicable store account settings.
18. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.
We do not warrant that:
- the Service will be uninterrupted, secure, timely, or error-free;
- Wallet Content will always be available, accurate, or recoverable;
- gift card balances, expiration dates, merchant data, or reminders will be accurate;
- merchants will accept digital copies, barcodes, screenshots, or stored card data;
- the Service will meet your expectations or requirements.
Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.
19. Limitation of liability
To the maximum extent permitted by law, Card Cubbie and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, lost profits, lost revenue, lost data, loss of goodwill, lost gift card value, unauthorized redemption, or cost of substitute services.
To the maximum extent permitted by law, our total liability for any claim relating to the Service or these Terms will not exceed the greater of:
- the amount you paid to Card Cubbie for the Service in the twelve months before the event giving rise to the claim; or
- USD $100.
These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
20. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Card Cubbie and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of the Service;
- your Wallet Content;
- your violation of these Terms;
- your violation of law;
- your violation of another person’s rights;
- disputes among shared wallet members;
- gift cards you add, share, redeem, transfer, or attempt to use.
This section does not apply where prohibited by applicable consumer law.
21. Governing law and venue
These Terms are governed by the laws of the State of Florida and the laws of the United States, without regard to conflict-of-law rules.
Subject to the “Consumer rights and regional terms” section below, the state and federal courts located in Florida will have exclusive jurisdiction over disputes that are not subject to arbitration or small claims court.
22. Optional arbitration clause for legal review
Except where prohibited by law, you and Card Cubbie agree to resolve disputes through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court where permitted.
You and Card Cubbie waive the right to a jury trial and the right to participate in a class action, class arbitration, private attorney general action, or representative proceeding, except where such waiver is prohibited by law.
This arbitration section does not limit rights that cannot be waived under applicable consumer protection laws.
23. Consumer rights and regional terms
Nothing in these Terms limits rights that you cannot waive under the laws of your country, state, province, or region.
If you are a consumer in the European Economic Area, United Kingdom, Switzerland, Australia, New Zealand, Canada, Brazil, or another jurisdiction with mandatory consumer protections, you may have additional rights, and certain limitations, disclaimers, governing law provisions, venue provisions, or arbitration provisions may not apply to you.
Where required by law, you may bring claims in your local courts or have disputes handled under local consumer protection procedures.
24. International use
Card Cubbie is operated from the United States. You are responsible for complying with the laws that apply to you where you access or use the Service.
You may not use the Service in a country or region where use would violate applicable sanctions, export control laws, or other legal restrictions.
25. Electronic communications
You agree that we may communicate with you electronically, including through the app, push notifications, email, or account notices. Electronic communications satisfy legal requirements that communications be in writing, unless applicable law requires another method.
You may opt out of promotional emails where available, but we may still send transactional, security, legal, subscription, account, and service-related messages.
26. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the app, by email, or by other reasonable means. The updated Terms will be effective when posted or as stated in the notice.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
